Determine whether you are pursuing Affirmative Asylum (not in removal proceedings, file with USCIS) or Defensive Asylum (in removal proceedings, raise in immigration court). Seek legal representation if at all possible.
Complete Form I-589 (Application for Asylum and for Withholding of Removal). The form asks detailed questions about your background, experiences, and reasons for seeking asylum. No filing fee.
Form: I-589
For affirmative cases: attend the asylum interview with an asylum officer. For defensive cases: appear before an immigration judge. Bring all evidence and witnesses to support your claim.
If granted asylum, apply for an Employment Authorization Document (EAD) and Refugee Travel Document (I-131). If denied by asylum officer, case is referred to immigration court for defensive proceedings.
One year after being granted asylum, file Form I-485 to adjust status to Lawful Permanent Resident. This provides a permanent green card.
Form: I-485
