The EB-1C category offers a fast-track green card for multinational executives and managers who are being transferred to work in the United States. This pathway is popular because it does not require PERM labor certification and is typically faster than EB-2 or EB-3.
To be eligible, you must: 1. Have worked outside the US for at least 1 year in the 3 years preceding the petition (in a managerial or executive capacity) for the same employer, an affiliate, or a subsidiary 2. Be coming to the US to work in a managerial or executive capacity for the same employer, an affiliate, or a subsidiary 3. The US employer must have been doing business for at least 1 year before filing the petition
Managerial capacity: Managing an organization, department, subdivision, function, or component; supervising and controlling the work of professional employees; having authority to hire, fire, and recommend personnel actions.
Executive capacity: Directing the management of the organization or a major component; establishing goals and policies; having wide latitude in discretionary decision-making; receiving only general supervision.
Function managers (those managing a function rather than people) can also qualify, but USCIS scrutinizes these petitions more carefully.
