For cap-subject H-1B: employer registers you in the USCIS H-1B electronic registration system during the March registration window (~March 1–18). If selected, employer may file a full petition.
Employer files an LCA with the Department of Labor certifying that they will pay the prevailing or actual wage (whichever is higher) and that hiring will not adversely affect US workers.
After LCA certification and (for cap-subject) lottery selection, employer files I-129 with H supplement. Earliest filing date for cap-subject is April 1 for October 1 start.
Form: I-129
If outside the US or choosing consular processing: schedule and attend H-1B visa stamp interview at a US Embassy or Consulate using DS-160. Bring I-797 approval notice and supporting documents.
Begin working on the approved start date. Track expiration dates and file for extension before the H-1B expires. With an approved I-140, extensions can go beyond the standard 6-year limit.
