The EB-1A is one of the most prestigious employment-based immigrant visa categories, reserved for individuals who have risen to the very top of their field. Unlike most green card pathways, the EB-1A requires no employer sponsor and no labor certification β you self-petition directly with USCIS.
To qualify, you must demonstrate extraordinary ability through sustained national or international acclaim. USCIS evaluates this using the criteria first codified in Kazarian v. USCIS (9th Cir. 2010), requiring you to meet at least 3 of 10 evidentiary criteria:

EB-1A is in the first preference category, meaning priority dates are often current for most countries (except India and China, which face significant backlogs). Premium processing (Form I-907) can adjudicate the I-140 in 15 business days.
After I-140 approval, you can adjust status (Form I-485) if in the US, or pursue consular processing abroad. Dependents (spouse and unmarried children under 21) receive derivative status.
