The EB-1B category provides a path to permanent residency for researchers and professors who are internationally recognized as outstanding in their academic field. Unlike EB-1A, the EB-1B requires an employer sponsor โ typically a university, research institution, or qualifying private company.
To be eligible, you must: 1. Be internationally recognized as outstanding in a specific academic area 2. Have at least 3 years of experience in teaching or research 3. Be entering the US in a tenure or tenure-track position, comparable research position at a university or institution of higher education, or a research position with a private employer that employs at least 3 full-time researchers
You must satisfy at least 2 of 6 criteria: - Receipt of major prizes or awards for outstanding work in the academic field - Membership in associations that require outstanding achievements - Published material in professional publications written by others about your work - Participation as judge of the work of others in your field - Original scientific or scholarly research contributions to the field - Authorship of scholarly books or articles in scholarly journals with international circulation
Your employer files the I-140 petition on your behalf. Unlike PERM labor certification, EB-1B does not require a PERM application, which significantly shortens the process. The employer must offer a permanent position.
Processing is typically faster than EB-2 or EB-3. Premium processing is available for expedited I-140 adjudication (15 business days). Priority date backlogs apply for India and China-born applicants.
