ETA-9089 — PERM Recruitment & Filing
Employer conducts mandatory recruitment to test the US labor market, then files ETA Form 9089 with DOL. For professional positions, 3 additional recruitment steps are required.
I-140 — File Form I-140
After PERM certification, employer files I-140 with USCIS. The petition establishes the priority date and confirms the alien worker's qualifications and the employer's ability to pay.
I-485 — File I-485 or Consular Processing
When priority date is current, file I-485 for Adjustment of Status in the US or DS-260 for consular processing at a US embassy. Include dependents as needed.
